General terms of hire

DAY TRIPS

The Verkehrsbetriebe Extertal GmbH (vbe) operates a draisine company on the rail section between Rinteln and Alverdissen of an approximate length of 18 km. Pro Rinteln e.V. and Lippe Tourismus & Marketing AG appear merely as mediator by offering ticket sales for draisine trips.

By renting a draisine, a hire contract is concluded between the customer and the vbe, on the basis of the intermediation of Pro Rinteln e.V. or Lippe Tourismus & Marketing AG. The contract consists of the following general hire terms:

  1. Conclusion of the hire contract
    1. The customer submits an enquiry in writing, by e-mail or telephone to Pro Rinteln e.V. or Lippe Tourismus & Marketing AG and subsequently receives a written offer from Pro Rinteln e.V. containing the services to be rendered. This offer expires at the end of the reservation period as stated within the offer.
    2. The contract concludes with the transfer of the payment as stated on the offer and the receipt by Pro Rinteln e.V. before the end of the reservation period. Otherwise the reservation lapses and Pro Rinteln e.V. is entitled to dispose otherwise of the draisine.
    3. If the enquiry is submitted less than 10 days before the beginning of the hire period, the contract may also be concluded verbally in person or by telephone.
    4. Making a reservation on site, the contract concludes with the payment of the rent and by signing the safety instructions.
    5. The safety instructions are a part of the hire contract and must be signed before the beginning of the draisine trip.
  1. Payment
    1. The rent price applies per draisine and day for a maximum of 4 persons. From May to Oktober the price per draisine per day is 75.00 € during the week (Wednesday till Sunday) and public holidays.
    2. The payment is due immediately with the conclusion of the contract. If the payment, under specification of the reservation number, is not received by Pro Rinteln e.V. before the end of the reservation period as stated in the offer, the reservation lapses and the customer loses all rights of the contract.
  1. Services

At the day of the hire, the draisines are issued starting from 9.00 a.m. Draisines are only released under the condition that the customer has read and signed the safety instructions issued on site.

The draisine has to be returned at the starting point before 5.00 p.m. In case of a late return, the customer will be charged with all resulting costs.

  1. Age restrictions

Draisines may only be hired by adults. Children and adolescents aged less than 16 years have to be accompanied by an adult.

  1. Cancellations
    1. The customer may withdraw from the contract at any time before the beginning of the hire period. The withdrawal has to be submitted in writing either to Pro Rinteln e.V. or Lippe Tourismus & Marketing AG. The date the withdrawal is received is significant for the amount of the cancellation fee.
    2. Not showing up at the hire place without prior withdrawal, will not be accepted as cancellation of the hire contract.
    3. If the customers withdraws from the hire contract, refunding of the payment may be requested of the vbe by contacting Pro Rinteln e.V. or Lippe Tourismus & Marketing AG. Under consideration of the regularly saved expenses resulting from the withdrawal and the under usual circumstances, possible alternative use of the hire object, the following cancellation fees apply:
  • If the withdrawal is made at least 10 days up to 1 month before the beginning of the hire: 20.00 € handling charge
  • If the withdrawal is made at least 1 day up to 9 days before the beginning of the hire: 50 % of the hire price
  • If the customer does not show up on the hire day: 100 % of the hire price

The customer may claim and prove to the vbe that the withdrawal caused a lower damage. The vbe may claim that a particularly high damage has been caused by the withdrawal, which has to be proved in detail.

  1. If the customer wants to place the hired draisine at somebody else’s disposal, Pro Rinteln e.V. or Lippe Tourismus & Marketing AG has to be informed in due time.
  2. Cancellation fees have to be paid immediately.
  1. Weather conditions

Draisines may be rented from 1st of April until 31st of Oktober every year at any weather conditions. In cases of deemed “bad” weather conditions Pro Rinteln e.V. or Lippe Tourismus & Marketing AG is not obliged to offer an alternative programme. Protection from the sun, rain and other weather conditions is not available. The customer has to dress and protect himself according to the weather conditions.

  1. Rights and duties of the customer in the case of performance impairments

In any case of performance impairment, the customer has to demand remedy. He is obliged to submit his complaints to the customer service of Pro Rinteln e.V. or Lippe Tourismus & Marketing AG, so remedy can be provided. If the impairment is originally caused by the employees of Pro Rinteln e.V., Lippe Tourismus & Marketing AG or the vbe, the legal liability regulations apply. The strict liability according to § 536 a BGB is explicitly excluded.

If damages to the draisine or the track are caused by the customer’s improper behaviour or non-compliance with the safety instructions, the customer is to be held responsible.

  1. Hire within tour operator’s all-inclusive offers

If the hire is organised within a tour operator’s all-inclusive offer, the contracting partner is the respective tour operator.

  1. Special conditions

The vbe reserves itself the right to reschedule hire periods due to transports taking place on the track for road-technical reasons.

  1. Ineffectiveness of single regulations, legal venue
    1. Should a regulation of the hire contract become void, the effectiveness of all other regulations remains unaffected. Should a single regulation of the contract become ineffective or incomplete, the respective regulation is replaced by an effective regulation, which is in line with the content of the contract and resembles the economic purpose of the ineffective or incomplete regulation as accurately as possible. The same applies for the here described hire terms.
    2. As far as legally allowed, the vbe is agreed to be a legal venue. This is significant in cases of civil disputes with independent commercial agents, persons whose jurisdiction is outside of Germany, or with persons of public or private rights.

  1. Services

At the day of the hire, the draisines are issued starting from 6.00 p.m., from the 1st of august at 5.30 p.m. Draisines are only released under the condition that the customer has read and signed the safety instructions issued on site.

The draisine has to be returned at the starting point before 9.30 p.m., from the 1st of august before 9.00 p.m. In case of a late return, the customer will be charged with all resulting costs.

In exceptional cases can it occur that the track is not well-conditioned or by force majeure is not completely serviceable.

In these cases the customer has no right of compensation such as fare reductions or refunds.

  1. Age restrictions
